Guide to Working in the USA for Brazilian Citizens

 Everyone who is a US citizen or permanent resident can work in the US; they don't need to apply for a work authorization paperwork. But if a person from another country wants to come to the US to work, they need to get the right kind of work visa. You need a job offer from a company in the US that will support your visa in order to get most US work visas. Some people also have non-employment-based statuses, which means they can work but must first get a work pass. People with a K1 visa, a temporary protected status, refugee seeker status, or F1 status who are having trouble paying their bills are all examples. For each type of US work visa, applicants must meet a different set of standards. These rules are usually set by law, and they change from time to time. If you want to get a visa, you should know what the requirements are first. They also come with a lot of paperwork and steps that both employers and workers have to follow. If you want to improve your chances of getting into the US and getting a job, you must follow the rules.

Work visas for permanent stay


Foreigners who get certain types of work cards in the US can become permanent residents, which means they can stay and work in the US forever. These are called immigrant or permanent visas based on work. People with this status are given green cards, which let them work anywhere in the US. Being a permanent resident of the United States gives you a lot of rights and perks. People are generally given green cards that are good for ten years and can be renewed as many times as they want. It is also easy to become a citizen of the US. If you have an employment-based green card, you can apply for citizenship by naturalization after five years of living in the country permanently. There are also family-based green card categories for people who are related to US citizens or legal permanent residents in certain ways. All employment-based green cards are given out in the order that the requests were received. You will have to stay in line until there is a visa available for you in that category after the annual limit for your category has been met. There are a lot of people waiting in line for some groups, and they may have to wait for years. After you apply, you might need to check the monthly visa report often to see how your application is going and when you can get a visa.

Green card groups based on jobs

There are 5 main types of employment-based green cards for people from other countries. Each has its own requirements for who can apply. There are also subcategories for some of them. Choose the job that fits your skills, abilities, and preferences the best. These are them:

The first choice EB1: Priority Workers and People with Extraordinary Skills

This type of green card is for workers who can show they are very good at certain things. Due to its strict rules and requirements, it is sometimes thought to be the most prestigious US permanent work visa. Those who want to apply must show a history of awards or accomplishments in their field.

There are three types of EB-1 green cards, which are for:

People with exceptional skills (EB-1A)

Great teachers and researchers (EB-1B)

A certain number of multinational leaders and managers

Applicants in the EB-1A sub-group can go straight to the US Citizenship and Immigration Services and make their own petition. In other words, they don't need a job offer or a company to help them get a green card.

The EB-1B and EB-1C visas, on the other hand, need an offer of work and a petition from a US-based employer


People with advanced degrees and people with exceptional abilities are given second preference EB2. This is for people with a high level of skill or an advanced degree. Usually, applicants need to have a work permit that has been accepted by the US Department of Labor (DOL). The petition must also be backed by a US company and there must be a job offer. There are also three subtypes of the EB-2 green card. These are:

Advanced degree Outstanding skills

Waiver of national interest (NIW)

People who want to apply for NIW don't need a job offer or work certification. They can also file their own petition with the USCIS.

Third Choice EB3: Professionals, skilled workers, and other workers

Just like the name says, the EB3 green card has three sections. "Skilled workers" are people whose jobs require at least two years of experience or training and are not casual or temporary. People who want to apply for a job must have the right schooling, experience, or other qualifications. USCIS might also think of related schooling as training. A "professional" is someone whose job requires at least a bachelor's degree in the US or a foreign equivalent, and who is a part of the professions. People who do unskilled work that takes less than two years of education, training, or experience are in the "other workers" subgroup. For all three subcategories, you usually need a job offer from a US company and a work permit that has been approved by the DOL. The boss must also fill out the form.

Fourth Choice EB4: Some Special Immigrants

This type of visa is for people who work in broadcasting, the military, religious groups, NATO-6 employees and their families, special immigrant youth, and G-4 foreign organizations. People who work for the US government abroad and some other eligible candidates are also available. It doesn't need a labor certification, and people who want to apply can do it themselves.

Fifth Preference (EB5): Investors who are immigrants


This is a capital investment visa for people from outside the US who want to start new businesses there. The spending has to create a certain number of jobs in the US. The EB-5 visa costs at least $900,000 and up to $1.8 million, based on the type of visa the applicant wants. Before you can get the visa, you will be given conditional permanent resident status that lasts for two years. During that time, you have to show that you meet certain EB-5 investment standards. With this, you will become a legal resident without any conditions and get a green card that is good for ten years.

Work visas for a short time

There are different types of temporary cards you can get if you only want to work in the US for a short time. These are called nonimmigrant work visas, and they are only good for a certain amount of time. Most of these visas can be renewed, but they usually have limits on how long you can stay in the US.
